The party seeking the stay bears the burden of proving adequate justification for the relief sought.

The trial court may stay proceedings as part of its inherent authority to control the disposition of cases and may consider factors such as the orderly administration of justice and judicial economy in deciding whether to grant a stay.

On December 9, 2010, the appellate court affirmed the trial court's January 29, 2010, judgment in the trust case and affirmed the denial of Kenny Industries' request for a stay of enforcement.

On appeal, this court affirmed the trial court's judgment and further found that Kenny Industries could not utilize the setoff provision in the SPA because it "required a showing of indebtedness to any member of the Kenny Group, which*** did not include the individual siblings."

The court also agreed with the trial court's finding that Kenny Industries did not meet its burden of showing justification for the stay.
