The court will not grant a rule nisi for a criminal information against a magistrate, so late in the second term after the imputed offence, as to preclude him from the opportunity of shewing cause against it in the same term.
In 1811 the court ruled that a prosecution had to be begun in the second term after commission of the offence complained of, there being no intervening assize, and sufficiently early to allow the magistrate to show cause during the same term.
