Senator McCutcheon was appointed by Governor Michelle Lujan Grisham to the district in southeastern New Mexico vacated in 2023 when Senator Gay Kernan retired.

in 2024, McCutcheon faced challenger Larry R. Scott in the Republican primary. The race intensified after the Rio Grande Foundation endorsed Scott, asserting his conservative credentials in an op-ed. This endorsement sparked controversy and a legal complaint about the Foundation's involvement in the election.[3]
