When either party objects to any portion of a magistrate judge's Findings and Recommendation, the district court must make a de novo determination of that portion of the magistrate judge's report.

The portions of the findings and recommendations not specifically objected to will be reviewed for clear error.

If an objection is made, the court reviews de novo only the portion to which the objection was made, the remainder is reviewed for clear error.

In accordance with the provisions of 28 USC § 636 (b)(1)(C) and Local Rule 304 (f), this Court has conducted a de novo review of this case.
