The federal court is charged with liberally construing a complaint filed by a pro se litigant to allow the development of a potentially meritorious case

A prisoner is entitled "to `a reasonable opportunity of pursuing his faith comparable to the opportunity afforded fellow prisoners who adhere to conventional religious precepts.'"

—reasonable opportunities must be afforded to all prisoners to exercise the religious freedom guaranteed by the First and Fourteenth Amendment

In a motion to dismiss for failure to state a claim under Rule 12 (b)(6), the allegations of the complaint and all reasonable inferences from the facts alleged must be taken as true.

Inmates retain the protections afforded by the First Amendment, "including its directive that no law shall prohibit the free exercise of religion."

Prisoners retain the First Amendment right to a reasonable opportunity to exercise their religious beliefs.

We do not suggest... that every religious sect or group within a prison—however few in number—must have identical facilities or personnel.

For while "[f] ederal courts sit not to supervise prisons," we must continually strive "to enforce the constitutional rights of all `persons,'including prisoners. "

This is a pro se complaint and, as such, it is held to less stringent standards than those drafted by attorneys.
