Because Agent Neer did not link the defendant to the murder in any way, but rather testified only that whoever killed Ms. Ansley did so with a sexual motivation, hie testimony did not violate the Alabama prohibition against expert testimony on the "ultimate issue."
The problem regarding the ultimate issue limitation is simply that in complex cases involving issues beyond the abilities of laymen, a jury may need an expert's opinion on the ultimate issue in order to reach a fair verdict
Morgan does not require courts to permit improperly phrased questions, such as questions that misstate the law or confuse the jurors.
There can be no doubt that, at the time the defendant entered his guilty plea, he knew that either he did or did not commit the murder for which he had been convicted.
Moreover, a third party confession is not so much "newly discovered evidence" as it is "newly disclosed" to the court.
