Purpose of use

This illustrates an important aspect of McCarthyism and the historically significant 1949 Smith Act trials of Communist Party leaders of Communist party leaders: the government threatened, and in some cases persecuted, defense attorneys representing Communists. The impact of this policy is conveyed, in a way that prose alone could not, by this photograph of the five Foley Square trial defense attorneys shortly after they were convicted.

Other information

The trial was a major event in US legal history, resulting in over 5 Supreme Court appeals. It also set the precedent that a judge can send attorneys to jail without a trial.
